These Terms of Service govern your use of the BURLY website, wholesale portal and related services operated by Melbourne Apothecary Group Pty Ltd trading as BURLY ("Burly", "we", "us" or "our").

By accessing our website or purchasing products from us, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use our services.

 

 

Eligibility

You must be at least 18 years of age or have permission from a parent or guardian to use our services and purchase products.

 

 

Products and Orders

All products are subject to availability.

We are not obligated to honour incorrect pricing caused by technical or human error.

 

 

Payment

Payment must be received in full before orders are dispatched unless otherwise agreed in writing.

Shipping and Delivery

Delivery timeframes are estimates only.

Risk in goods passes to the customer once an order is handed to the shipping carrier.

Burly is not responsible for delays caused by courier networks, customs processing, weather events or incorrect delivery information supplied by the customer.

Authority to leave shipments may be granted at the customer’s risk.

 

 

Returns and Refunds

Returns are handled in accordance with Australian Consumer Law.

We may offer exchanges or store credit for change of mind purchases at our discretion.

Unless faulty, products must be unused and returned in original packaging.

 

 

Product Use

Burly grooming products are intended for external use only.

Customers should discontinue use if irritation occurs.

Results may vary depending on individual hair type, scalp condition and styling routine.

 

 

Promotions, Giveaways and Loyalty Programs

Burly may run promotions, prize draws, giveaways or loyalty programs from time to time.

We reserve the right to modify, suspend or cancel promotions at any time.

Eligibility requirements may apply.

Promotion outcomes and prize allocations are determined at Burly’s discretion.

Promotions must not be abused, manipulated or misrepresented.

 

 

Accounts

Customers are responsible for maintaining the confidentiality of their account login details.

We may suspend or terminate accounts where fraudulent activity, misuse of promotions or brand-damaging behaviour is suspected.

 

 

Intellectual Property

All Burly branding, product names, imagery, written content and packaging design remain the property of Melbourne Apothecary Group Pty Ltd.

Content must not be reproduced, repackaged or used in connection with resale or marketing without written permission.

 

 

User Generated Content

By tagging Burly or submitting content to us, you grant Burly the right to repost, publish or use this content for marketing and promotional purposes.

 

 

Limitation of Liability

To the extent permitted by law, Burly is not liable for indirect or consequential loss arising from use of our website or products.

Nothing in these Terms excludes rights available under Australian Consumer Law.

 

 

Governing Law

These Terms are governed by the laws of Victoria, Australia.

We may update these Terms from time to time.
